For the past 20 years, a management rights business has been one of the most successful businesses one can purchase.

The core aspect of the management rights contract with the body corporate is to care take and maintain the common property. Assuming the manager completes all the duties competently, remuneration is paid. This remuneration is usually fixed to CPI with a ratchet clause.

The caretaking agreement is usually for a total term of 19 – 30 years in New Zealand and up to 25 years in Queensland and 10 years in New South Wales. The agreements normally run on a 3 by 3 by 3 term. For example the first term will for 5 or 10 years and the manager will have the option to renew for a further defined term.

The beauty of this business is that for every extra dollar of net profit a management rights owner can produce, it is worth up to 5 times in capital gain when the business is sold.

Management Rights vs. Motels

The Lancaster Group does not believe it is a fair competition to choose between a leasehold motel and a management rights business. The owner of the leasehold motel has a rent review at agreed times and has to open up their books to the landlord. A management rights business owner is contracted to care take the common property and is paid remuneration to do so. If the motel operator has been successful and increased turn-over they will lose a third of it to the landlord, thereby increasing the value of the landlord’s investment.

A successful management rights owner will only benefit themselves by increasing the value of the business. The motel operator will also have to maintain and pay for all replacements and repairs and maintenance of all chattels including spa and swimming pools. They may also be obligated to repaint the building exterior at regular intervals. A management rights business owner does not meet any expenses that relate to the replacement, repair or maintenance of any common property structure or asset.
If repairs are required within a unit that is part of the managers letting pool, it is the owner of that unit who pays for repairs or replacement of chattels.
Management Rights traditionally have been popular with banks due to the Trust account that always has positive funds and is never overdrawn due to regulations in Australia.
